- "I, Jessie Coles (a Colored man) of the Town of Charlottesville
in the County of Albemarle State of Virginia being of a sound and
disposing mind and moving to make and ordain this to be my Last
Will and Testament, hereby revoking all former Wills or Testaments
heretofor by me at any time made. "Herein 1st I desire and bequeath
unto my wife Jane June Coles (a colored woman) all the property
and estate of every character or description real personal or mixed
of which I may die [sired] or possessed or to which I shall be [en]
any manner entitled at the date of my death, said Jane Coles is
to hold, have, [possess] and enjoy all my said estate; including
all debts due to me; [for] and during the time of her natural life
only..."

- "I, Annie, E. Brown of Red Hill Farm Proffit Post Office
Albemarle County Virginia make this my last will, I give devise
bequeath my estate and property real and personal as follows that
is to say, I will that all my just debts and funeral expenses be
paid out of my personal property that I may own at the time of my
death by my Executors hereinafter to be named, I will and bequeath
to my beloved brother James H. Brown the sum of fifty dollars which
I loaned him without not or security, I will and bequeath to the
heir of my beloved Sister Elizabeth O. Donnell the sum of ten dollars
I will and bequeath to my beloved brother Nathan O. Brown one-hundred
dollars, I will and bequeath to my beloved Sister Mary S. Brown
the entire remainder of my estate real personal or mixed.
- "I appoint my beloved brothers James H. Brown and Nathan O. Brown
of Proffit Post Office Albemarle County Virginia as Executors of
this my last Will without bond or security.

declared this instrument as my last will at Proffit Post Office
Albemarle County Virginia on the seventeenth day of April nineteen
hundred and six.

Office Albemarle County Virginia on the seventeenth day of April
nineteen hundred and six signed and sealed this instrument and published
and declared the same as and for her last will in our presence and
we at her request in her presence and in the presence of each other
have hereunto written our names as subscribing witnessed.

- In Vacation: In the Clarke's Office of the Circuit Court of Albemarle
County, May 16th 1906. This paper writing perporting to be the last
Will and testament of Miss Annie E. Brown, deceased, bearing date
on the 17th day of April 1906, was this day produced in said office,
and was proved by the oaths of O.P.Leake and G.A.Hughes the subscribing
witnesses thereto, who made [inserted: that on this seventeenth
day of April 1906], they were present at the request of the said
Annie E. Brown and saw her sign this paper writing as and for her
last will and testament, that they signed as witnesses in the presence
of the testatrix and in the presence of each other, and that on
the 17th day of April 1906 the said Annie E. Brown was of sound
mind and memory. Whereupon this paper writing is considered fully
proven as and for the time will and testament of Miss Annie E. Brown,
deceased, and is admitted to the record as such

- "In the name of God Amen:
- "I, James Daniel Flanngan of proffitt, Albmarle County, Va., being
of sound and disposing mind do hereby make, publish and declare
this my last will and testament, revoking all others.
- "First: It is my desire that all my just debts be paid as soon
as procticable [sic] after my death. Second:- I give and devise
unto my youngest daughter, Julia, for services rendered by her,
that portion of land owned by me in Albemarle, Co. that is enclosed
with a wire or wire and picket fence, lying between the road running
from the main road at corner of Church lot towards my house and
around by where my son Washington now lives, with his line to the
main road, back with road by colored church in corner of sd. roads
to starting point. This land is now in woods and there are no houses
on it except a hen house belonging to my son, Washington which is
to be moved. This land extends to the yard fence around Washington's
house.
- "Third:- I devise unto my son Washington the land on which the
house in which he now lives is which house was built by home and
all improvements thereon put by him. Sd. land being what he has
enclosed except a sufficiency at the end to Proffit to let the road
running by my house and his house be extended through sd land devised
to him to the public road, leading to Proffitt, at the same width
it is between my house and his house say eight feet.

Daniel / Last Will and Testament (p. 2)
- "It is my desire that this road running through my land between
the two public roads be kept open for the common use of all my children.
I charge this land so devised to Washington with my burial expenses
and make it a condition for this devise, taking effect that Washington,
if living, shall see that I have a decent burial.
- "Fourth:- I devise unto my wife Ann Marie Flannagan, during her
natural life and after her death to be inherited by and equally
divided between my two daughters Mary Dabney Flannagan and Julia
Flannagan, a certain portion of the land owned by me in Albemarle
XCo near proffit and not heretofore devised and bounded as follows:-
Beginning at north east corner of cold. church lot thence in a northwestward
direction with the piece of land heretofore devised to my daughter
Julia, thence with Washington's line to Mr. O. P. Leaks line, thence
with Mr. Leak's line to a post [added: on Leak's line and past being
the (finish?) post] or 32 feet south of the southwest corner of
my graveyard enclosure, thence eastward with a row of apple trees,
but on north side a sufficient distance to allow fence being run
without damaging sd. apple trees, say four feet, thence by a walnut
three [sic] straight line to a point about seventy five yards on
road from starting point thence southward with public road to starting
point sd- tract being the portion upon which my buildings and garden
are located.
- "I bequeath and devise this tract as aforesaid and described with
all appurtenances thereunto belonging unto my two daughters Mary
Dabney and Julia at the death of my wife, Ann Maria Flannagan, because
of valuable considerations and that I think it my duty.
- "Fifth:- All the rest of my land not heretofore specifically devised,
I also devise unto my wife Ann Maria Flannagan during her natural
life and after her death to be equally divided between all of my
children except my son Washington and my two daughters Mary Dabney
and Julia who are to have no share in my land or estate, except
that heretofore devised unto them. The child or children of any
of my children now dead or that may die hereafter are to have their
parents share. In witness hereto I have set my hand and seal this
15th day of April 1905.

we in the presence of James D. Flannagan the testator and in the
presence of each other witnessed the signing and execution of the

Daniel / Last Will and Testament (p. 3)
- "witnesses and other subscribing witness A. C. Austin not being
present. The said G. A. Hughes testified that the time James Daniel
Flannagan signed and acknowledged this paper that he was of sound
mind and disposing memory. Thereupon said paper writing is considered
fully proved and admitted to probat [sic] as the last true will
and testament of James Daniel Flannagan dec'd.

Will and Testament (p. 1)
- "I, Ben F.Brown, a resident of Proffit, Albemarle, Virginia,
being of sound mind, make this my last will, on this the 29th. day
of July, 1943. I hereby bequeath to my wife, Elmira Patterson Brown,
all of my estate for her own use and benefit forever, and appoint
her my executrix, without bond, with full power to sell, mortgage,
lease or in any other manner dispose of the whole or any part of
my estate.

- IN THE CLERK'S OFFICE OF THE CIRCUIT COURT OF ALBEMARLE COUNTY,
AUGUST 26th. 1943.
- A paper writing bearing date the 29th. day of July 1943, purporting
to be the last will and testament of BEN F. BROWN, deceased, late
a resident of Albemarle County, Virginia, was produced before me,
Eva W. Maupin, Clerk, in the aforesaid Clerk's Office and offered
for proof and probate, and was proved by the oaths of Jane D.Clark
and Elizabeth B.Lewis, the two attesting witness thereto who testified
that they were both personally present when the said Ben F. Brown
signed and declared said paper writing to be his will and at his
request and in his present and in the presence of each other, they
subscribed their names as attesting witness thereto.
- The said Jane D.Clark and Elizabeth B.Lewis further testified
to the best of their knowledge and belief and said Ben F.Brown was,
on the 29th. day of July 1943, the day said paper writing bears
date, of a sound mind and in disposing memory and perfectly capable
in all respects of making and executing a will.
- The said paper writing is theretofore considered fully proven
and is admitted to probate as and for the true last will and testament
of Ben F.Brown, deceased.

Will and Testament (p. 1)
- "I, Kate Coles, widow, residing near Eastham, Albemarle County,
Virginia, being of sound mind, do hereby make this my last will
and testament hereby revoking all other wills heretofore made by
me.
- I. I wish all my just debts paid as soon after my death as possible.
- II. I give and bequeath all money and personal property of every
description of which I die possessed to my son, Hastings Coles.
- III. I give and bequeath to my son, Hastings Coles, the land on
which his residence and other buildings now stand, consisting of
one acre more or less, to be used by him as he pleases during his
natural life and at his death to go to his children share and share
alike."

and Testament (p. 2)
- IV. I give and bequeath to my son, William D. Coles, my residence
and other buildings and the land on which they now stand consisting
of one or more acres, lying along the west side of Stony Point Road
and bounded on the south by the road leading from Stony Point Road
through my property and on the north by E. E. Blue and on the west
by property of Bella Coles, but the grave yard on the read of this
tract of land is hereby reserved for the joint use of my four sons,
their heirs and assigns.
- V. All the residue of my land I give and bequeath to my daughter-in-law,
Pauline Coles, to be used by her as she pleases during her natural
life and at her death to go to the children of Pauline Coles and
Hastings Coles share and share alike.
- VI. Should any of my sons desire to sell any of the land inherited
under this will, they must first give the others an opportunity
to buy before selling to anyone else.
- VII. I hereby nominate and appoint my son, Hastings Coles, sole
executor of this my last will and testament and direct that no bond
or security be required of him as such.

FEBRUARY 6th, 1952.
- A paper writing bearing date the 15th day of October 1941, purporting
to be the last will and testament of KATE COLES, deceased, late
a resident of Albemarle County, Virginia, was produced before me,
Eva W. Maupin, Clerk, in the aforesaid Clerk's Office and offered
for proof and probate and was proven by the oath of Mildred Coles,
on of the three attesting witnesses thereto, the other witnesses,
R. T. Minor, Jr., and Mary B. Minor, having departing this life.
- The said Mildred Coles testified that she and the said R. T.
Minor, Jr., and Mary B. Minor were all personally present when the
said Kate Coles signed and declared said paper writing to be her
will and at her request and in her presence and in the presence
of each other, they subscribed their names as attesting witness
thereto.
- The said Mildred Coles further testified that on the 15th day
of October 1941, the day said paper writing bears date, the said
Kate Coles was of a sound mind and disposing memory and perfectly
capable in all respects of making and executing a will.
- The said paper writing is therefore considered fully proven and
is admitted to probate as and for the true last will testament of
the said Kate Coles, deceased.
